Two Console Modders Get Arrested

The Department of Justice raided three videogame stores in the Washington D.C. area for selling modded "super Xboxes" for $500. The modded consoles let gamers install bigger hard-drives and play downloaded pirated games. The confiscated consoles had 15 games ripped onto them. Selling hardware with copied games definitely is a crime, but is it under "fair use" to have a modded console with backup copies of your own games?
